Terms and Conditions

Welcome to the protected.cc website (hereafter called the 'website'). By continuing to browse this website you agree to be bound by these Terms and Conditions. Please read them as they contain important legal information - we've tried to keep them plain and simple.

1. Definitions

The term 'we' or 'us' refers to protected.cc limited, a company registered in England number 7057660 whose registered address is 5 Marylands, RH16 3JZ, United Kingdom.

The term 'you' refers to the viewers of our website and/or users of the protected.cc service.

2. General Terms

Your use of this website and of the protected.cc service is conditional on these Terms and Conditions. Should you violate these terms we reserve the right to close any account you may have with us or restrict your access to our website or services.

The protected.cc service is provided 'as is' and we accept no liability, either express or implied, for any loss or damage you may incur as a result of your use of our website or services. This does not affect your statutory rights under English law.

3. Copyright

We retain copyright over any content on the protected.cc website (save for the exceptions described below). You may not download or reproduce content from our website without our express permission. The sole exception to this is where your Internet browser may download content automatically as part of the browsing experience.

You retain copyright over any data that you submit to the protected.cc service. You grant us a perpetual non-exclusive worldwide license to store and reproduce this content to the sole extent as is required for us to provide the protected.cc service.

You accept that once you have uploaded data to our service it may not be possible to completely remove such data. We will endeavour to store such data in a secure manner as per our obligations under the UK Data Protection Act (the 'Act'), but we cannot be held liable for any loss of data or breach of data security not covered by the Act.

4. Acceptable Use

You agree that you will not use the service for any illegal or obscene purpose. This includes, but is not limited to, uploading data that is illegal under the laws of England, uploading data which we may reasonably consider to be obscene or uploading data to which you do not hold the copyright (unless you have the permission of the copyright holder).

You may not use our service in such a way as to have a detrimental effect on other users of our service. Where we feel your use of the service may affect other users we reserve the right to ask you to moderate your use of our service. If you persist we will consider this a breach of these Terms and may terminate your account without warning.

We may disclose information on your use of our service or copies of any data you have uploaded to our service to a third party where required by a UK Court. We will only do this where we have been served with a Court Order or similar injunction and, unless we are specifically forbidden from doing so, we will notify you should this occur.

5. Payment

Some services that we provide may require payment. We use a third party provider called PayPal to process all payments on our behalf. No payment is deemed to have taken place until we have received electronic notification from PayPal that the transaction has been completed. We do not store any sensitive cardholder data in our systems under any circumstances.

Payments for services are non-refundable. When you first create an account to use our services you are provided with free credits which you are expected to use to determine suitability of our service before you purchase any additional services.

If you reverse a payment or issue a chargeback without good reason then we reserve the right to close your account. We may also hold you liable for collection costs and reasonable administrative fees.

6. Indemnity

You agree to indemify protected.cc (including any directors, staff or other agents) from any claims or actions that may arise as a result of your use of our service, any breach of these Terms or any other related legal matters. Our liability in such cases is limited to the minimum required by the laws of England.

7. Termination

Either party may terminate this agreement at any time by notifying the other party either through the protected.cc website, by email or by registered post. Any payments made for our service prior to the termination of the agreement are non-refundable, although we may, at our sole discretion, consider refunds on a case by case basis depending on the circumstances.

If you wish to terminate this agreement by email please be aware that if you do not receive email confirmation from us of your termination request we may not have received your email. In such a case you will continue to be bound by these Terms until you are able to prove we have received your email.

8. Other

If any part of these terms is deemed to be unenforcable by a court or other properly constituted tribunal then it shall be removed from these Terms and will in no way affect the remaining Terms.

This agreement is made under the laws of England and you agree to the non-exclusive jurisdiction of the English courts in the event of any dispute.

This agreement is effective from the 21st August 2010 and can be changed by posting a new version to the protected.cc website.

Privacy Policy

Protected.cc has adopted the following privacy policy as part of our commitment to protect any personal information which you may provide to us through this website or by any other means. Any change to this privacy policy will be posted on this website and will become effective 7 days after posting. This privacy policy does not apply to any other website linked via this website. Other websites may have their own privacy policies.

1. What We Collect

We may collect personal information such as name, address or telephone number by means of contact forms.

We may record technical information such as IP address or browser version to monitor and improve the effectiveness of the website. Information collected for this purpose will be anonymous and will not be linked with personally identifiable information

If you become a member of protected.cc we may collect and use information relevant to the administration of your membership such as name address, email address, usernames or passwords, etc.

If you choose to send data to protected.cc to protect, we may store that data and related information neccessary to provide the protected.cc service (such as digital fingerprints, email header information, etc)

Should you choose to purchase resources from protected.cc, we may collect information relevant to the processing of your order.

2. How We Use Information We Collect

Any personal information will only be used for direct purposes of protected.cc. We will not sell, trade or rent your information to third parties without your express permission.

Information may be stored on servers outside of the United Kingdom, but only in accordance with EU Safe Harbor principles and in compliance with the UK Data Protection Act 1998.

3. How We Store Your Information

Any information we collect will be held securely and in accordance with the UK Data Protection Act 1998. More information on the Act and your rights under it can be found on the Office of the Information Commissioner website.

4. Accessing or Changing Information We Hold

Under the Data Protection Act 1998 you are entitled to a copy of all the information we hold on you by submitting a Subject Access Request. We may charge up to £10 for this service, and must respond to you within 40 days. For further information, please contact us at talktous@protected.cc.

We will, on request, change any information we hold on you which is incorrect or misleading. We will also, on request, delete any and all information held on you.

It may not be technically possible to delete or retrospectively amend some data you have submitted to protected.cc. If this is the case we will de-link the data from any personally identifiable information we may hold, making it impossible to subsequently associate the data with any individual or account holder.
